12. Customer Acknowledgment Regarding Copyright Disputes
12.1 Nature of Works
All works offered in this shop are original, unaltered publications. We do not sell modified versions created after 2007.
12.2 Public Domain Position
We operate on the legal position that original L. Ron Hubbard works are in the Public Domain under applicable Swiss and international copyright law. This position is based on documented legal analysis regarding the dissolution of the original copyright holder (HASI) in 1977 and other factors detailed in our Legal Notice.
12.3 Disputed Claims
Various organizations dispute this position and claim copyright ownership. We maintain our legal position and are prepared to defend it in Swiss courts if necessary.
12.4 Customer Acknowledgment
By purchasing, you acknowledge awareness of these disputes and agree that:
- You purchase for personal, educational, or research purposes
- You assume responsibility for compliance with laws in your jurisdiction
- You will not use these materials in ways that create legal risk for yourself or others
12.5 No Warranty Against Third-Party Claims
While we believe our position is legally sound, we cannot guarantee that third parties will not assert claims. We specifically disclaim any warranty that possessing or using these materials will be free from third-party challenges in all jurisdictions.
12.6 Indemnification
You agree to indemnify College for Knowledge against any claims arising from your use of purchased materials in jurisdictions where such use may be contested.
13. Applicable Law and Jurisdiction
13.1 These Terms are governed exclusively by the law of Switzerland, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
13.2 For consumers habitually resident in the EU, the mandatory consumer protection provisions of their country of residence also apply insofar as they provide a higher level of protection.
13.3 Place of jurisdiction is Zug, Switzerland, insofar as legally permissible.
13.4 EU consumers may bring proceedings in their country of residence.
14. Severability
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected. Invalid provisions shall be replaced by valid provisions that come closest to the economic purpose of the invalid provision.
